Terms of Service

These terms apply to everyone who uses migosai.io. By creating an account, generating a video or an image, or buying credits, you agree to them.

Who we are

MigosAI (migosai.io) is an independently operated online service that turns two photos into an AI rap duet video. "We", "us" and "MigosAI" mean the operator of migosai.io. MigosAI is operated by its founder as a sole trader, not as a company.

MigosAI is not affiliated with, sponsored by or endorsed by Migos, Quavo, Takeoff, Offset or COLORS (A COLORS SHOW). The orange-studio scene is an original setup inspired by a viral internet trend.

Four mailboxes are monitored, and a person reads all of them:

• support@migosai.io — support, billing, refunds, cancellation, and reports of content that breaks our rules.
• legal@migosai.io — legal notices and security reports.
• privacy@migosai.io — privacy questions, data requests, and requests from parents and guardians.
• dmca@migosai.io — copyright and trademark complaints.

What the service is

MigosAI turns the photos and settings you provide into an AI-generated rap duet video. You upload two portraits (or one group photo and choose two crop frames), preview a free "booth photo" of the two people in an orange studio, and then spend credits to generate a short video of 5, 8 or 10 seconds that you can download and share. The rap is original AI-generated audio (using your own audio is coming soon). MigosAI does not use the original recording of any existing song and does not clone the voice of any real artist.

MigosAI is a software-as-a-service product delivered over the internet. There is nothing to install on our side and nothing is shipped to you. When a payment is confirmed, the credits or plan you bought are added to your account immediately. Paid videos carry no MigosAI watermark.

What comes out is AI-generated. It may look imperfect, resemble other people's work, or be unsuitable for your purpose, and you should review it before you publish or share it. Results vary between runs. We may change, add or discontinue features, with reasonable notice where that is possible.

AI models we use

MigosAI is built on third-party AI models and services. This is the current list:

• Kuaishou Kling v3 Standard, Kling v3 Pro and Kling LipSync (hosted by fal.ai) — animate the booth photo into the rap duet video and lip-sync it to the AI rap track.
• ByteDance Seedance 2.0 (hosted by fal.ai) — a backup: if Kling cannot process your photos, Seedance generates the video from the booth photo, the two performer photos and the same AI rap track.
• Google nano-banana (Gemini image editing, hosted by fal.ai) — generates the free booth photo preview.
• ElevenLabs Music (hosted by fal.ai) — generates the AI rap track.
• DeepSeek (accessed through OpenRouter) — writes the rap lyrics.
• fal.ai image safety classifier — an automated NSFW check on every photo you upload and on generated images.
• Waffo Prompt Sift — an automated content-safety check on the text you and the models write.

fal.ai forwards the inputs of each video step (the booth photo, the performer photos, the AI rap track and the prompt text) to the company that makes the model — Kuaishou for Kling, ByteDance for Seedance — which processes them and runs its own safety checks. These companies may process that data outside the European Economic Area, the United Kingdom and the United States.

Payments are handled by Waffo, files are stored on Cloudflare R2, and transactional email is sent through Resend. See the privacy policy for what each of them receives.

Before a prompt reaches a model, it passes our blocked-terms list and the content-safety check above. The same checks screen what the models produce before it is delivered to you. The safety classifier and Prompt Sift do not generate anything; they only decide whether something is allowed.

We may switch to other models as better ones appear. When we do, we update this page before the change goes live. We are not affiliated with, sponsored by or endorsed by any of the model providers; their names and trademarks belong to them.

Who may use MigosAI

• 13 and over. You may create an account if you are at least 13 years old.
• Under 13. MigosAI is not directed at children under 13. A child under 13 may only use MigosAI with the verifiable consent and supervision of a parent or legal guardian, who must create and manage the account and who is responsible for the child's use of it. If we learn that an account belongs to a child under 13 and was created without that consent, we close it and delete its data (see the privacy policy).
• Purchases. You must be at least 18, or have a parent or guardian make the purchase, to buy credits or a plan.
• If the age of digital consent where you live is higher than 13, that age applies instead.

You are responsible for keeping your account credentials confidential and for everything that happens under your account. Tell us at support@migosai.io as soon as you notice unauthorized use.

Publishing elsewhere

Anything you publish on another platform is subject to that platform's own terms and community standards, and to its moderation. You are responsible for checking that a video or image you generate here complies with those rules before you upload it. We have no control over another platform's decisions about your content or your account there, and a moderation action on another platform is not grounds for a refund from us.

Plans, credits and billing

Every account gets 3 free booth photo previews and needs no card. A booth photo that fails to generate does not use one of them. There is no free video: making a video costs credits, and the cost is shown before you generate.

Paid options are:

• Basic, Pro and Studio — subscriptions, billed monthly in advance. Each billing period grants a set number of credits.
• Credit packs — a one-time purchase that tops up your balance. Nothing renews.

Current prices, credit amounts and what each plan includes are on the pricing page; we do not repeat them here so that they cannot go out of date.

How payment is taken

Payments are processed by Waffo, a third-party payment processor that acts as the merchant of record for your purchase. Your card details go to them and are never stored on our servers; we receive the order result and the payment record they return. Prices are shown before checkout, and any applicable taxes are added at checkout.

Recurring charges

By starting a Basic, Pro or Studio subscription you authorise the payment processor to charge your payment method the subscription price at the start of each monthly billing period automatically, until you cancel.

You can cancel at any time from Settings → Billing, without contacting us. Cancelling stops the next renewal; you keep your plan and your remaining credits until the end of the period you already paid for. If you would rather we cancelled it for you, email support@migosai.io and we will.

Credits granted by a subscription expire at the end of each billing month and do not roll over. Credits you buy in a credit pack never expire.

Refunds

The short version; the full policy is on the refund policy page and controls if the two ever differ.

• Failed generations are refunded automatically. If a video fails to generate, or a result is blocked by our output screen, the credits return to your balance without you asking. A rejected prompt or photo is never charged.
• Completed videos are not refundable, except where the law requires it. Generation costs us money the moment it starts, so credits spent on a delivered result are not refunded. Content that we remove after review is the one exception.
• Credit packs. A pack can be refunded in full within 14 days of purchase, provided none of its credits have been used.
• Monthly plans. A first charge or a renewal you did not intend can be refunded in full if you ask within 14 days of the charge and have not used any of the credits granted by that period.
• Cancel any time from Settings → Billing. Cancelling stops the next renewal; we do not prorate a cancellation mid-period.
• Statutory rights. If consumer law where you live gives you a right of withdrawal, nothing here limits it.

To ask for a refund, email support@migosai.io from the address on your account with the order number from Settings → Orders. We reply within two business days.

Content rules and moderation

Every prompt is screened by automated content-safety checks before it reaches a model, and everything a model makes is screened again before it is delivered to you. Every photo you upload is checked by an automated NSFW classifier before it is stored; a photo that is rejected is never kept, and we log the rejected attempt without storing the image. Results remain subject to human review after they are made. The full rules are on the content policy page.

By uploading a photo you confirm that:

• You have the consent of every person in it, or the photo is of you. Only upload photos of people who have agreed to appear in an AI video.
• It is not a photo of a minor used for anything sexual or harmful. Sexual content involving minors is banned outright and reported to the authorities.
• You are not using it to impersonate someone for fraud or harassment, or to present a real person as saying or doing things they did not.
• You are not making content that shows a real person in a sexual or defamatory way.

You also may not generate, or attempt to generate, content that is sexual, that promotes hate or extremism, that facilitates harm, or that copies someone else's copyrighted characters, logos or works. You agree not to break the law, infringe anyone's rights, attempt unauthorized access to our systems, or interfere with the service. We may reject prompts and photos, remove content, and suspend accounts that repeatedly try to route around the screen.

Music, voices and trademarks

The rap in a MigosAI video is original AI-generated audio. Using your own audio or video is coming soon; when it becomes available, you must have the right to use whatever you upload. MigosAI does not use the original "Hotel Lobby" recording and does not clone the voices of Quavo, Takeoff or Offset. Migos, Quavo, Takeoff, Offset and COLORS (A COLORS SHOW) are names of their respective owners; MigosAI is not affiliated with any of them and uses those names only to describe the internet trend the tool is inspired by.

How long we keep your files

Uploaded performer photos are deleted after 24 hours. Booth previews are kept for 7 days and generated videos for 30 days, so download anything you want to keep. When uploads of your own audio or video become available, they will be deleted after 24 hours. Details are in the privacy policy.

What you generate

• You own your results. As between you and us, you own the videos, images and other output you generate with MigosAI, and you may use, modify, publish and monetise them, subject to these terms, to the rules of the platforms you publish on, and to any third-party rights in what you asked for.
• No exclusivity. AI models can produce similar output for different people. We do not promise that your result is unique, and we cannot give you rights in material that someone else already owns.
• Our licence to operate the service. You give us a licence to store, process and display your prompts and results so that we can provide the service to you. Your photos, previews and videos are private to your account; we never publish them.
• What you upload. You must have the right to use every photo you upload (and, once available, any audio or video), including the consent of the people in it, and you give us the same limited licence to process it for you. We do not use your uploads to train any model.

Intellectual property

The site, the software behind it, the MigosAI name and brand, and the content we publish are ours, and are protected by copyright, trademark and other intellectual property laws. Nothing in these terms transfers any of that to you.

Termination

We may suspend or terminate your access if you violate these terms. You may close your account at any time from Settings.

Disclaimer and limitation of liability

The service is provided "as is", without warranties of any kind. AI-generated output may be imperfect, be unoriginal or be unsuitable for your purpose, and we do not warrant that it will be otherwise.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages arising out of your use of, or inability to use, the service, including any action another platform takes on content you publish there, and any misuse of a video by a person you made it with or shared it with.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these terms excludes liability that cannot be excluded by law.

Changes to these terms

We may update these terms. Material changes are reflected in the date at the top of this page and, where appropriate, announced through the service. A change never applies retroactively to a purchase you already made.
